Limited statutory compensation has been available for victims of sexual assault and abuse in Western Australia since 1971. Recently with the introduction of the Commonwealth Redress scheme statutory compensation is more readily available for survivors of institutional sexual abuse. At the same time the reform of laws relating to common law damages in relation to sexual abuse has provided an additional form of compensation/damages for sexual abuse victims. These three systems have respective advantages and limitations. This seminar will discuss the differing remedies/payments available and consider the respective merits of each system. In addition, it will analyse the differing forms of assessment and procedures involved in those systems.
Robert Guthrie is Adjunct Professor at the John Curtin Institute of Public Policy at Curtin University in Perth Western Australia. He was admitted to practice as Barrister and Solicitor in 1982. He was later Head of School of Business Law at Curtin University. He was sworn in as an Assessor for Criminal Injuries Compensation in WA in 2010.
